3. How We Share Your Information

We do not sell your personal information for money. We may share information with:

  • A successor entity in connection with a merger, acquisition, financing, or sale of some or all of our assets.

We may also share aggregated or de-identified information that cannot reasonably be used to identify you.

4. Cookies and Tracking Technologies

You can control cookies through your browser settings; disabling cookies may limit certain features of our website. Where required by law, we will present a cookie consent banner allowing you to manage non-essential cookies.

5. Data Security

We maintain administrative, technical, and physical safeguards designed to protect information from unauthorized access, disclosure, alteration, or destruction, including encryption of sensitive data in transit and role-based access controls. No system can be guaranteed completely secure, and we cannot ensure or warrant the absolute security of information you provide to us.

6. Your Choices and Rights

6.1 Marketing Communications

You may opt out of marketing emails by following the unsubscribe instructions in those emails. We may still send you non-marketing communications related to your application or Line of Credit, such as servicing notices and legally required disclosures.

6.2 Access, Correction, and Deletion

Depending on your state of residence, you may have the right to request access to, correction of, or deletion of personal information we hold about you, subject to exceptions such as our need to retain records for legal, regulatory, or lending-related recordkeeping obligations. To make a request, contact us using the information in Section 10.

6.3 California Residents

If you are a California resident, the California Consumer Privacy Act (as amended) may give you additional rights, including the right to know what personal information we have collected, the right to request deletion, the right to correct inaccurate information, and the right to opt out of certain sharing for cross-context behavioral advertising. Note that information collected in connection with credit applications is generally subject to separate federal financial privacy laws (such as the Gramm-Leach-Bliley Act), which may apply instead of or alongside state privacy law. We do not discriminate against you for exercising your privacy rights.

7. Data Retention

We retain personal information for as long as necessary to service your Line of Credit, comply with legal, tax, and regulatory recordkeeping obligations (which for credit-related records is often measured in years after account closure), resolve disputes, and enforce our agreements. When information is no longer needed, we take reasonable steps to securely delete or de-identify it.

8. Children’s Privacy

Our Services are intended for business use by adults and are not directed to children under 18. We do not knowingly collect personal information from children. If we learn we have collected information from a child, we will take steps to delete it.
